How Delta-8 THC Is Made

Cannabis plants produce less than 1% Delta-8 THC naturally. The Delta-8 sold in stores is manufactured by converting CBD — extracted from legal hemp — through acid-catalyzed isomerization. This chemical conversion process is why some regulators classify commercial Delta-8 as “synthetic” or “semi-synthetic” rather than naturally occurring.

H.R. 5371's exclusion of cannabinoids “not capable of being naturally produced by Cannabis sativa L.” could apply to manufactured Delta-8 — but since Delta-8 does occur naturally in the plant (just in tiny amounts), the legal argument is genuinely ambiguous. The FDA's forthcoming cannabinoid classification lists are expected to resolve this.

The November 2026 Federal Impact on Delta-8

When the new federal hemp definition takes effect, Delta-8 products face a two-pronged challenge:

The total THC threshold

Products are now measured on total THC, not just Delta-9. A Delta-8 gummy with 25mg of Delta-8 THC per piece would need the container's total THC (including Delta-8, Delta-9, THCA, and any other THC-class cannabinoids) to stay under 0.3% by dry weight.

The 0.4mg container cap

Even if the plant-level threshold were met, the finished product can't exceed 0.4mg of total THC per container. A standard 10-pack of 25mg Delta-8 gummies contains 250mg total — exceeding the cap by 625x.

Will Delta-8 show up on a drug test?

Standard urine drug tests measure THC metabolites, and Delta-8 THC produces the same THC-COOH metabolite as Delta-9. Most drug tests cannot distinguish between Delta-8 and Delta-9 use. Can I travel with Delta-8 across state lines?

Transporting Delta-8 from a legal state into a state where it's banned constitutes possession of a controlled substance in the destination state. Is Delta-8 safer than Delta-9 THC?
